Two new Union Bay Improvement Board Trustees may have been elected on April 30th, but the UBID Civil Claim for defamation on a blog against Landowner Mary Reynolds still drags on in the Supreme Court of British Columbia.

The latest Court document for Case S-107671, Vancouver Registry includes sworn Affidavits of current Trustee Alan De Jersey and former Trustees David Godfrey and Denis Royer with their complaints that because Ms. Reynolds has posted an "Election Fever in the Comox Valley" cartoon (see Attachment), she has breached the Consent Order not to publish "false or malicious statements" about UBID or the Plaintiffs.

These De Jersey/Godfrey/Royer Affidavits may be viewed by the public in their entirety on the Union Bay News Now blog at http://unionbaynewsnow.blogspot.com/.

Mr. De Jersey has sworn under oath that he believes that the image on the right is himself since according to De Jersey, "the name 'AL' appears on the mid-body..." and "this cartoon figure appears to be wearing a 'Harley Davidson' belt buckle", stating that he owns a Harley Davidson motorcycle.

After being subjected to my husband's infatuation with various TV "adult" cartoon series for 20 years, I can attest that the cartoon character is none other than Ralph Wiggum of the long-running "The Simpson's" cartoon series.

Isn't the lettering on his shirt "RAL" for "Ralph"? And if someone were to draw a post a cartoon of Marge Simpson driving an old model Honda, would that mean I was Marge? (I drive a 1992 Honda.)

The two ousted Trustees (and Plaintiffs in the Reynolds' defamation case) have sworn under oath that the two hillbilly cartoon characters on Ms. Reynolds' blog are "representative of our physical proportions..." and as Mr. Godfrey states "appears to have been printed and published the day after Denis Royer and I [David Godfrey] were reported to be standing for re-election to the Board of Trustees of the Union Bay Improvement District by local media". (Note that the wording of Mr. Royer's and Mr. Godfrey's Affidavits are identical word-for-word but with their respective names added in the appropriate places.)

When I first saw the cartoon, I believed it represented our local election for MP (i.e. John Duncan, Ronna-Rae Leonard, Mike Holland) on May 2nd since it was entitled "Election Fever in the Comox Valley" (with no mention of Union Bay). And only the pig character pictured with a "Vote for Me" sign was an actual candidate. Was I wrong in assuming that the two hillbilly characters were citizens getting ready to vote?

After reading the Royer and Godfrey Affidavits, I strained my eyes to find some resemblance between the two hillbilly characters and Royer/Godfrey. I wonder "Which hillbilly is Denis Royer? Which hillbilly is David Godfrey?"

Although this all may seem rather comical and "Monty Pythonesque", it is a serious matter before the B.C. Supreme Court which is costing me and other residents $118,000 and climbing.

As Vancouver Sun journalist Stephen Hume so eloquently ended his column entitled "Tiny town runs up huge bill suing a taxpayer who blogs with sarcasm on political decisions" on May 5, 2011,
"...And so, suddenly, this sleepy don'tblink-or-you'll-miss it community south of Courtenay finds itself at the vortex of a free-speech tempest. The rest of us will await the outcome with interest."

The taxpayers of Union Bay also await the outcome of this costly Supreme Court case with vested interests.

Landowner de Jersey says "On the other hand I am a landowner and tax payer of Union Bay and this waste of time and money to deal with this unbalanced individual angers me to no end."

On whose advice did this Trustee initiate legal action, with both feet in the public trough, action that the courts had found to be illegal in Powell River?

Who was minding the store?
